Gaming4Health.com is a website produced by iConecto, a division of Medical Alliances, Inc.
Gaming4Health.com (G4H) provides a social networking site dedicated to promoting community and information for the Healthy Gaming Industry. By using G4H’s services, you are agreeing to abide by the following Terms of Service (TOS).
G4H reserves the right to change or modify any of these terms, for any reason, and any such modification or change will be effectively immediately.
NO content contained within G4H may be copied, saved, distributed or used in any manner without the express permission of the copyright or trademark owner, as otherwise permitted by the copyright fair use exception or other applicable law.
1. Content
a. All content provided by G4H (newsletters, databases, articles, etc.) is protected by copyrights and, in some cases, trademarks. Some content may be provided by third parties, whose copyrights or permissions were obtained by G4H for distribution to its Users.
b. User content includes any content provided by the general membership (conversations in chat rooms, blogs, postings on message boards, etc), and the copyright may be retained by the providing User. With respect to any content you provide, you:

grant to G4H a royalty-free, perpetual, world-wide, irrevocable license to use, copy, create derivative works based on, and redistribute the content;

warrant that you have all rights necessary in the materials you submit to G4H to grant the foregoing license and that the use of such material by G4H and its Users will not infringe on any other party's rights; and

agree to indemnify and hold G4H and its Users harmless from any claims or damages arising as a result of your use of the site or the content you provide,including but not limited to attorneys' fees.
c. You may not provide, or encourage others to provide, any content which:
violates or infringes on the trademark, copyright, privacy, publicity, or other rights of any other party;
is unlawful, defamatory, harassing, abusive, threatening, or obscene; or contains any injurious instruction.
2. Conduct

Your conduct on the site not only reflects upon your own person, but also reflects on the overall level of professionalism throughout the entire organization, including that of your fellow Users. G4H is a respected community, and its Users are primarily made up of patients, healthcare practitioners, researchers, game developers and others in the industry who are participating in order to share information in the Healthy Games Industry, and to promote health and wellness.
b. You may not transmit or solicit others to transmit information, or engage in any behavior, that violates any state, local, international, or Federal laws.
c. You may not harass, defame, disparage, threaten, or cause or direct unwanted or uncomfortable attention upon another User or other person.
d. You may not sell, lease, license, or use any information about other Users for commercial or political purposes.
e. Chat rooms may be used only for their intended purposes. Rooms may be designated as either "free" or "scheduled." Free rooms are for general discussions on a wide range of subjects, with communications between Users being determined by those Users in the room at the time, as long as such communications adhere to the pre-determined subject or "theme" of the room. Scheduled rooms are for scheduled discussions, which are hosted by a moderator or room host.
You may not use any room to advertise, promote or solicit others to advertise or promote any service, product, organization, periodical, or association that directly competes with G4H without the express written permission of G4H.
f. Forums may be used only for their intended purposes. Forums will be labeled as topical discussion areas for various writing subjects. Most Forums will be un-moderated, and it is up to every User to ensure and promote beneficial communications.
You may not use any message board to advertise, promote or solicit others to advertise or promote any service, product, organization, periodical, or association that competes with G4H without the express written permission of G4H.
g. You may not impersonate another User, G4H employee, moderator, room host, or board monitor, nor in any way present yourself as any person other than yourself.
h. You may not transmit or encourage others to transmit information about yourself, another person, or any product, service, organization, association, or periodical that to your knowledge is false, inaccurate, outdated, or misleading.
i. You may not transmit, encourage others to transmit, disclose, use for commercial, political, or other purpose, or engage in any action intended to procure, confidential information from or about other Users.
3. Privacy and Usage of Listings by G4H
User’s contact, log-in and other information is held by G4H for internal purposes only, and will not be sold to any third party, for any reason. However, we may be required by law to share information through lawful requests (such as court orders and/or subpoenas) from lawyers, courts or other government agencies. G4H may also need to share user information to prevent fraud, imminent harm or protect against other illegal activities.
When you register with G4H, or enter a game, device or resource into our GameBase, we collect some personal information such as name, email, address and other information that you provide to us. Further, through your general use of the site, we also collect session data (ie. which pages you visited, Forum messages you read and posted) and may set a cookie on your computer that tracks each session in order to recall what you have previously customized for your log-in.
Forum posts, videos, graphics and other files that you share in public areas are accessible by the entire G4H community, therefore the information you share in such instances are at your own risk.
4. Access
a. You are responsible for your own access to the Internet, through any access provider you choose.
b. You are responsible for all hardware, software, telephone or other connections,
and charges or fees for accessing the Internet.
c. G4H will use reasonable efforts to provide continuous and easily accessible access to the G4H website. As G4H is provided on the Internet, conditions may arise that adversely affect your ability to access the website that are beyond the control of G4H. G4H does not guarantee the dependability or availability of any third party product or service.
5. Spam
You may not use G4H to gather listings of email addresses of G4H Users for the purpose of spamming, or sending any other unsolicited email(s) for advertisements and/or marketing.
6. Feeds and Linking
G4H allows the User to use RSS feeds for the purposes of linking to the information on the G4H website. User agrees not to post other User information for any purpose, unless they receive written permission. User also agrees not to use any other information, pages or listings on G4H for any purpose but their own personal use.
7. Copyrights
User retains all copyrights to their personal information, and warrants that they have that right. The GameBase is a database of resources (games, devices, simulations, etc.), produced solely for the use of our users, and for promotional purposes only. Even though we use various graphics, videos and other promotional materials to demonstrate each game, all copyrights and trademarks are retained by the game’s developer.
Any abuses of copyrights should be made known to G4H by emailing Bradley@medicalalliances.com.
8. Indemnification
User agrees to hold harmless, defend and indemnify G4H from all liabilities and claims, including legal and other expenses, that arise from Users breach of this agreement, violation of law, or other wrongful conduct.
In case of any abuse, copyright infringement or other illegal or inappropriate activity, you can contact G4H by emailing Bradley@medicalalliances.com. We will make all best and reasonable efforts to respond to all queries and reports of abuse in a timely manner.
9. General Information
This TOS constitutes the full agreement between User and G4H. The relationship between the User and G4H is governed by the Laws of the State of Delaware.
10. DISCLAIMERS
THE G4H WEBSITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" BASIS. G4H DOES NOT WARRANT THAT BY JOINING THE COMMUNITY, OR THROUGH USE OF ANY INFORMATION PROVIDED, THAT YOU WILL BE "BETTER SUITED" OR "MORE LIKELY" TO OVERCOME ANY ILLNESS OR CONDITION. G4H DOES NOT WARRANT THE ACCURACY, COMPLETENESS, RELIABILITY, AUTHORITY, USEFULNESS, TIMELINESS, OR NON-INFRINGEMENT OF THE CONTENT PROVIDED BY ITS USERS.
G4H, ITS OFFICERS, PARTNERS, EMPLOYEES, AND DIRECTORS SHALL NOT BE HELD LIABLE FOR ANY DECISION MADE OR ACTION TAKEN BY YOU FOR YOUR USE OF OR DEPENDENCE ON ANY INFORMATION OR SERVICES PROVIDED WITHIN THE WEBSITE, NOR FOR ANY CONSEQUENTIAL, SPECIAL, OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
G4H DOES NOT IN ANY WAY GUARANTEE OR ENDORSE ANY DOCTOR, HOSPITAL OR CLINIC, DEVELOPER, SERVICE OR ANY OTHER THIRD PARTY INFORMATION OR CONTENT PROVIDER, SPONSOR OR ADVERTISER.
